MaineHealth Government Affairs’ Regulatory Changes & Guidance Updates is an internal newsletter that will be distributed weekly including highlights, policy changes, and other pertinent announcements from the state and federal governments. Please note that any formal submissions to the state or federal government on behalf of MaineHealth are coordinated by the Government Affairs Team. State & Federal Rulemaking

  • None this week.


State:

  • The DHHS Division of Licensing and Certification released a notice of rulemaking adoption for 10-144 CMR Ch. 129, Personal Care Agency Licensing Rule. Please click here for a clean copy of the rule and here for a redlined version; a copy of the comments and responses can be found here. Guidance for the timeline that the Division will follow in enforcing certain provisions of the rule can be found here.
  • MHDO released a notice of agency rulemaking proposal for changes to Chapter 100, Enforcement Provisions, to ensure compliance with new rules 90-590 C.M.R. Chapters 340 and 800. A basis statement and summary of changes can be found here. Comments are due September 16.

State Programs & Announcements

  • DHHS issued a notice to providers of Section 13, Targeted Case Management Services reminding them that text messaging and other forms of mobile messaging are not acceptable forms of substantive contact.
  • OMS released a notice that Certified Community Behavioral Health Clinic (CCBHC) certification documentation is due September 6.
  • OMS issued a notice for Section 65, Behavioral Health Services providers about a temporary claims payment delay.
  • OMS issued an update for pharmacy providers about the status of the restoration of MEPOPS following the Change Healthcare cyberattack.
  • OMS will host a webinar on September 3 on MaineCare in education.

Federal Programs & Announcements

  • HHS outlined the US Government's response to the current mpox outbreak, following the World Health Organization's declaration of a public health emergency of international concern.
  • The CDC issued an advisory to clinicians and public health officials warning of increased Oropouche virus, which is transmitted by mosquitos.
  • The CDC issued an advisory alerting providers about an increase in cases of parvovirus B19.
  • CMS will host a webinar on August 21 at 1pm to share hospice-related updates around the FY25 Hospice Final Rule.
  • CMS released a Preexposure Prophylaxis (PrEP) for HIV & Related Preventive Services informational website for health care providers and is available at https://www.cms.gov/medicare/coverage/prep.
